UNLICENSED SELLING OF THC-INFUSED PRODUCTS IS ILLEGAL IN ARIZONA
Published on April 25, 2025
Arizona Attorney General: Selling THC-infused food and drinks without a license is illegal in Arizona, even if allowed under federal law. Our state laws are stricter. Under the Smart and Safe Arizona Act, unlicensed businesses may face penalties starting April 24.
This includes: • Drinks like THC-infused sodas, teas, coffees, or juices • Edibles such as THC-infused candies, gummies, chocolates, baked goods (brownies, cookies), or snacks • Products containing delta-8 THC, delta-9 THC, or other hemp-derived THC variants that cause intoxication Even if these products are derived from hemp and legal under the Federal Farm Bill of 2018, Arizona's stricter state laws prohibit their sale by unlicensed businesses.
So, any THC-infused edible or beverage sold by a shop, cafe, or company without a specific Arizona marijuana license must stop as of April 24, 2025.
